Who you are contracting with

iPaddock is operated by Arnau Mas i Hernandes (49644806L), a sole trader established in Spain, at Ctra. Nova, 38, 08530 La Garriga, Barcelona, Spain. “We” and “iPaddock” mean that business.

iPaddock is not affiliated with, endorsed by or connected to iRacing.com Motorsport Simulations, LLC. “iRacing” is their trademark and is used here only to describe what the products are for.

What the site is

A marketplace where independent sellers offer two things to iRacing drivers: one-to-one coaching sessions, and downloadable car setups and telemetry datapacks. Sellers set their own prices and their own availability. We review sellers before they may list, and we operate the payment, delivery and dispute machinery.

We are the merchant of record

You buy from iPaddock, not from the seller directly. Your card statement says iPaddock, we issue the receipt, and we are who you come to when something goes wrong. We then pass the seller their share.

The seller remains responsible for what they actually deliver: the quality of a setup, turning up to a session, and holding any rights in what they upload.

Accounts

You need an account to buy, and you must confirm your email address before you can sign in. One person, one account. You must be old enough to enter a binding contract where you live. We can suspend an account that is used for fraud, abuse, or reselling other people’s files.

Prices and payment

• Sellers price in euro (EUR), and euro is the currency of the contract. Depending on where you are, checkout may show and charge you a converted amount in your own currency instead; the rate for that conversion is Stripe’s, not ours. Either way your bank may add its own fee on top.
• Sellers price between €5.00 and €500.00 per item.
• iPaddock keeps 10% of each sale by default; the rate that applies to an order is recorded on that order and later rate changes do not alter it.
• Payment is taken when you buy, including for coaching, so a slot is genuinely reserved.
• Some sellers offer a subscription instead of a one-off sale. It renews monthly until you cancel, and what cancelling does to access you have already paid for is on the refunds and cancellations page.

Delivery

Setups and datapacks are available to download as soon as payment succeeds. Coaching happens at the time you booked, over whatever channel the coach specifies. What you buy is licensed for your own use: sharing or reselling a file ends your access to it.

Selling

If you sell here: you must own or be licensed to sell what you upload, your listings must describe accurately what a buyer gets, and you must honour bookings you accept.

Because we are the merchant of record, the buyer’s money reaches us first and we pass on your share. How that works:

• Payouts run through Stripe. You open a Stripe account through us and accept Stripe’s Connected Account Agreement directly with them. Stripe verifies your identity and holds your bank details, so we never see them.
• We release your earnings to your Stripe account’s bank account periodically. It is not one payout per sale, and it is not immediate.
• We hold a sale’s earnings for a short period after it is made, and hold new sellers’ earnings for longer. We may also hold a release while a refund, a claim or a card dispute on one of your sales is open.
• A refund can cost you your share of that sale, and the payment fee on it. Which of us bears a refund depends on why it happened: a session you did not turn up to comes back from you, a goodwill refund we decide to give does not. Stripe keeps its fee on a refunded payment either way, so somebody has to carry it, and it is not carried by the party that did nothing.
• If a buyer disputes a charge with their bank, the money is taken from us and we recover your share of it, plus the fee the bank charges for the dispute, from your balance straight away. If the dispute is later decided in your favour we return all of it.
• If a refund or a recovery is larger than the balance you are holding, your Stripe balance goes negative and Stripe recovers the difference from your bank account.

Law, and telling you about changes

These terms are governed by Spanish law. If you are a consumer you keep the protection of the mandatory rules of the country you live in, and may bring a claim there. If we change these terms materially we will say so by email before the change applies to you; the terms that govern a purchase are the ones published when you made it.
